Purpose: To attend to your queries and/or requests. Likewise, in relation to the special categories, and in particular, the health data that may be involved in the processing, the circumstance that enables the processing of the same is the public interest in the field of public health, as well as those aimed at guaranteeing high levels of quality and safety of health care and medical devices.

Storage period: periods established in the regulations.

Legal basis: compliance with the legal obligations established in current legislation on pharmacovigilance.

Type of data: age, sex, contact details and health data related to the consultation.

 

Who do we transmit your personal data to?

Your personal data will not be shared with third parties, except when necessary for the proper execution of the services we provide. This may include transmission to suppliers who assist in delivering our services, such as PROCARE HEALTH IBERIA SL, VAT Nº B66278995 and registered office located at AV MIGUEL HERNANDEZ, 21 BAJOS 46450, BENIFAIO (VALENCIA).

Data may be disclosed in Italy and/or abroad, strictly in accordance with the above-mentioned purpose, and consequently processed, only in relation to the mentioned purpose, by other persons: professionals and consultants as well as by persons allowed to access to your personal data according to National or Community regulations. 

For the same reasons, our partners and/or employees   may process your data in their capacity of executors or processors. 

Procare Health Italia SRL may also disclose your personal data to public bodies and authorities (administrative or judicial) in cases where a legal obligation applies.

 

Rights of data subjects

PROCARE HEALTH ITALIA SRL informs Users that they may exercise their rights set forth in art. 7 of L.n.196/2003, including the right of access, rectification, limitation, deletion, portability, opposition to the processing of their personal data and the right not to be subject to automated decisions, including profiling, before the Data Controller, as well as the withdrawal of the consent given.

Right of Access: This is the right of the user to obtain confirmation as to whether their data is being processed and, if so, the specific personal data processed and the legal information of the processing (purposes, legal basis, storage periods, transfers, origin of the data, etc.).

Right of Rectification: It is the right of the affected party to have the data that turns out to be inaccurate or incomplete modified. In relation to the website, it can only be satisfied in relation to information that is under the control of the website, for example, deleting comments published on the page itself, images or web content containing personal data of the user.

Right to Limitation of Processing: This is the right to limit the purposes of the processing originally foreseen by the data controller in certain cases.

Right to Erasure: This is the right to delete the user’s personal data, with the exception of what is provided for in the GDPR itself (freedom of expression and information, retention obligations, formulation, exercise or defence of claims, etc.).

Right to Portability: The right to receive the personal data that the user has provided, in a structured, commonly used and machine-readable format, and to transmit them to another controller when the processing is based on consent or the performance of a contract and is carried out by automated means.

Right of Opposition: It is the right of the user not to carry out the processing of their personal data or to cease the processing of the same by the website when the processing is based on legitimate interest or public interest or when it is direct marketing processing.

Right not to be subject to automated decisions, including profiling: Where the processing is not necessary for the conclusion or performance of a contract, nor is it authorised by European Union or Member State law and is not based on consent, you have the right not to be subject to a decision based solely on automated processing,  including profiling, which produces legal effects or similarly significantly affects you.

Right to withdraw consent: For any processing based on your consent, you have the right to withdraw consent, at any time and free of charge.

To exercise any of the data protection rights described above, you must follow the following instructions:

The letter sent by the owner of the personal data (interested party) requesting the exercise of rights must take into account the following:

  • You must reliably identify yourself and, in the event of doubts about the identity of the applicant, you will be asked to correct the request (e.g. by requesting more information, such as the ID number, the ID document, the email you provided, etc.)

 

  • The request may be made by the representative, legal or voluntary, when he or she is duly identified and authorised by the owner of the data (by means of an express authorisation from the owner to exercise the very personal rights regulated in the regulations on the protection of personal data).
  • Petition in which the request is specified (Right(s) that are intended to be exercised). If you do not refer to a specific processing, you will be provided with a response in relation to all the processing that affects your personal data. If you request information about a specific treatment, only the information about it. If you request it by phone, you will be instructed to do so in writing and will be informed of how you can do it and the address to which you have to send it. You will never be given information over the phone.
  • Postal or electronic address for notification purposes.
  • Documents accrediting the request made, if necessary.

The applicant must use any means that allows proof of sending and receiving the application.

Finally, we inform you that you have the right to file a complaint with the Spanish Data Protection Agency in the event that you become aware of or consider that an event may involve a breach of the applicable data protection regulations.

PROCARE HEALTH ITALIA SRL undertakes to adopt the necessary technical and organizational measures, in accordance with the level of risks that accompany the processing carried out by them and indicated in the section on the terms and conditions of use, in order to guarantee their integrity, confidentiality and availability.
